Terms of Use
Effective: August 25, 2025
1) Purpose & Scope
These Terms govern authorized staff use of SmartCampus Attendance (“Service”) to support attendance, hall-pass/call-down workflows, staff dashboards, and emergency accounting that identifies a student’s last-known location and time from scan/attendance events. Local Education Agencies (LEAs) control access and direct how the Service is used.
2) Accounts & Roles
- Access is provisioned by the LEA. Users must keep credentials secure and follow LEA security practices.
- Permissions are role-based (e.g., teacher, secretary, admin, district admin). Users may access data only as needed for their duties.
3) Permitted Use
- Use the Service solely for legitimate educational purposes authorized by the LEA.
- Record attendance and manage hall-pass/call-down operations in accordance with school procedures.
- During drills or incidents, authorized staff may use the Service to view last-known location and time from scan/attendance events.
4) Prohibited Conduct
- No unauthorized exports, bulk downloads, scraping, or sharing of student data.
- No attempts to bypass technical controls or access data outside your role or assigned students.
- No entry of information that violates LEA policy or law.
5) Data Ownership & Privacy
- The LEA owns and controls student data. We act as a school official/processor under FERPA.
- The Privacy Policy describes data elements and safeguards in more detail.
- If these Terms conflict with the executed DPA/NDPA with an LEA, the DPA/NDPA governs.
6) Exports & Auditing
- Student-record exports are limited to District Admins and only when enabled by LEA policy.
- Exports are policy-controlled (default off) and all export attempts and outcomes are audited.
- When exports are authorized by the LEA, records are delivered only through district-approved secure methods; email delivery is not permitted.
7) Availability & Changes
We may update features or perform maintenance. Material changes affecting data processing will be communicated to LEAs. LEAs are responsible for communicating appropriate changes to their staff.
8) Security Responsibilities
- Protect credentials, avoid sharing accounts, and log out of shared devices.
- Report suspected security incidents or improper access immediately to the LEA and through the Contact link in this site’s footer.
- Do not export or redistribute student data outside approved LEA channels.
- Do not email PII or upload student records to personal cloud drives. Use only district-approved secure channels for authorized record delivery.
9) Termination
Accounts may be suspended or terminated by the LEA or by us for policy violations, security risks, or misuse.
10) Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules.
